Returns & Refunds 

If you are not satisfied with your purchase, you may return merchandise for a full refund within 30 days of purchase.  We cannot accept any returns if the product was used and does not have its original tags or is not in its original packaging.

Customers are responsible for return shipping charges.

The following items cannot be returned or replaced:

  • Items without receipt or proof of purchase
  • Items not purchased on badfishsupply.com (purchases made via retail partner, must be returned to them directly)

Please email crew@badfishsupply.com for return authorization. Please indicate your order number, items, and reason for return and we will provide further instructions.

Exchanges

Please inspect your product before opening to make sure it is what you were expecting. If you would like to exchange a product, please return the unopened item(s) for a refund within 30-days of the delivery date and place a new order. The customer is responsible for return shipping Please email crew@badfishsupply.com for return authorization. Please indicate your order number, items, and reason for return and we will provide further instructions. 

Damaged or Defective Merchandise: 
If you believe you have received a damaged or defective product, immediately discontinue use of the product and contact us at crew@badfishsupply.com

We will make every reasonable effort to assist with replacement or return. Please include your original order number and proof of purchase in the email. All such inquiries are handled on an individual basis. Policy on damaged or defective items is subject to change.

The friend may contact Badfish at to request the removal of this information from our database.

We reserve the right to refuse to process an order due to suspected fraud or unauthorized or illegal activity. 6. THE SUBSCRIPTION CONTRACT BETWEEN YOU AND US
Recur offers three subscription types: rebillable monthly subscriptions (“Monthly Subscriptions”); prepaid monthly/annual subscriptions (“Prepaid Subscriptions”); and prepaid gift subscriptions of three, six or twelve months (“Gift Subscriptions”). Monthly Subscriptions:

By purchasing a Monthly Subscription, you acknowledge that your subscription has an initial and recurring payment feature and you accept responsibility for all recurring charges prior to cancellation. Your subscription will be automatically extended for successive monthly periods, at the then-current subscription rate. To cancel your Monthly Subscription at any time, you must logon to your account and follow the cancellation procedures or call or email us and we will do it for you. If you cancel, you may use your subscription until the end of your then-current subscription term. Recur may submit periodic charges (e.g., monthly) without further authorization from you, until you provide prior notice that you have terminated this authorization or wish to change your payment method. Such notice will not affect charges submitted before Recur reasonably could act.

Prepaid Subscriptions: By purchasing an Prepaid Subscription, you acknowledge that your subscription has an initial pre-payment feature for the specified period of service. At the end of the year, your subscription will be automatically extended for another term of the same period at the then-current subscription rate. We do not offer refunds for Prepaid Subscriptions.

Gift Subscriptions: For Gift Subscriptions, the subscription will not be renewed after the then-current term expires. You cannot cancel a Gift Subscription and the pre-paid fee is non-refundable.

We reserve the right to revoke your subscription at any time as a result of a violation of these Terms or the Privacy Policy. Membership is void where prohibited by law.

7. PRODUCT INFORMATION; LIMITATION ON QUANTITIES
Excluding any content that may be submitted by Members from time to time, we strive to ensure that the information on the Site is complete and reliable. Certain information may contain pricing errors, typographical errors and other errors or inaccuracies, which we may correct without liability. 17. COPYRIGHT INFRINGEMENT; NOTICE AND TAKE DOWN PROCEDURES
Recur specifically prohibits the posting of any content that violates or infringes the copyright rights and/or other intellectual property rights (including rights of privacy and publicity) of any person or entity. If you believe that any material contained on this Site infringes your copyright or other intellectual property rights, you should notify us of your copyright infringement claim in accordance with the following procedure. 18. SEVERABILITY
If any part of these Terms shall be held or declared to be invalid or unenforceable for any reason by any court of competent jurisdiction, such provision shall be ineffective but shall not affect any other part of these Terms, and in such event, such provision shall be changed and interpreted so as to best accomplish the objectives of such unenforceable or invalid provision within the limits of applicable law or applicable court decisions.

19. WAIVER; REMEDIES
The failure of Recur to partially or fully exercise any rights or the waiver of Recur of any breach of these Terms and Conditions by you shall not prevent a subsequent exercise of such right by Recur or be deemed a waiver by Recur of any subsequent breach by you of the same or any other term of these Terms. The rights and remedies of Recur under these Terms and any other applicable agreement between you and Recur shall be cumulative, and the exercise of any such right or remedy shall not limit Recur right to exercise any other right or remedy.

20. GOVERNING LAW
The laws of the State of New York shall govern these Terms without regard to conflict of laws provisions.

21. DISPUTES
Any dispute relating in any way to your visit to the Site or to the products you purchase through the Site shall be submitted to confidential arbitration in New York, New York; provided, however, that to the extent that you have in any manner violated or threatened to violate our intellectual property rights, we may seek injunctive or other appropriate relief in any state or federal court in the State of New York. You hereby consent to, and waive all defenses of lack of personal jurisdiction and forum non conveniens with respect to, venue and jurisdiction in the state and federal courts of New York. Arbitration under these Terms will be conducted pursuant to the Commercial Arbitration Rules then prevailing at the American Arbitration Association. The arbitrator’s award will be final and binding and may be entered into as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under these Terms will be joined to an arbitration involving any other party subject to this Terms, whether through class action proceedings or otherwise. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of, related to or connected with the use of this Site or these Terms must be filed within one (1) year after such claim of action arose or be forever banned.

Arbitration is more informal than a lawsuit in court. Arbitration uses a neutral arbitrator instead of a judge or jury, allows for more limited discovery than in court, and is subject to very limited review by courts. Arbitrators can award the same damages and relief that a court can award. YOU AND RECUR AGREE THAT EACH MAY ONLY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Further, unless both you and Recur agree otherwise, the arbitrator may not consolidate more than one person's claims with your claims, and may not otherwise preside over any form of a representative or class proceeding. The arbitrator may award declaratory or injunctive relief only in favor of the individual party seeking relief and only to the extent necessary to provide relief warranted by that party's individual claim.
